1. Introduction
Welcome to Beacon. These Terms of Service ("Terms") govern your access to and use of the Beacon application and related services (the "Service") provided by Beacon Social / Dotmove ("we," "us," or "our").
About Beacon:
Beacon is an activity tracking app that lets you record and share physical activities, create visual moments during activities, and connect with other users through your moments and movement. The Service includes live activity sharing, a feed of activities, moments (photos with text), and related social and tracking features.
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
2.1 Age and Capacity
- You must be at least 13 years old to use the Service.
- If you are under 18, you should have parental or guardian consent before using the Service.
- You must have the legal capacity to enter into a binding agreement in your jurisdiction.
2.2 Account Responsibility
- You are responsible for maintaining the confidentiality of your account and for all activity under your account.
- You must provide accurate information and update it as needed.
- One person or legal entity may not maintain more than one account for misuse or evasion of these Terms.
3. Description of the Service
3.1 What We Provide
- Activity tracking and recording (e.g., routes, distance, duration, speed)
- Creation and sharing of "moments" (photos and text) linked to activities
- Live sharing of activities with other users
- Feed and social features to view and engage with other users' activities and moments
- Profile, notifications, and other features we describe in the app or on our website
3.2 Changes and Availability
- We may change, suspend, or discontinue any part of the Service at any time, with or without notice.
- We do not guarantee that the Service will be available at all times or in all regions.
- We may impose limits on certain features or restrict access in accordance with law or our policies.
4. Your Account and Registration
4.1 Sign-In
- You may sign in using supported third-party providers (e.g., Google). Your use of such providers is also subject to their terms and policies.
- You must not use another person's account or allow others to use yours.
4.2 Account Termination by You
- You may stop using the Service at any time and may delete your account through the in-app settings or by contacting us.
- Our Privacy Policy describes how we handle your data upon account deletion.
5. User Content and Conduct
5.1 Your Content
- "User Content" means any content you submit, post, or display through the Service, including activities, moments (photos and text), comments, profile information, and other materials.
- You retain ownership of your User Content. You are solely responsible for it and must have all rights necessary to post it on the Service.
5.2 License to Us
- By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, display, reproduce, modify, and distribute your User Content as needed to operate, promote, and improve the Service and to comply with law.
- This license continues for a reasonable period after you remove content or delete your account (e.g., for backups, legal compliance, and enforcement).
5.3 Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe or misappropriate any third party's intellectual property, privacy, or other rights
- Harass, abuse, threaten, or harm others, including minors
- Post content that is defamatory, obscene, or that promotes violence or illegal activity
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the Service or our systems, or attempt to gain unauthorized access
- Use the Service for any commercial purpose without our prior written consent, except as we explicitly allow
- Scrape, crawl, or use automated means to access the Service without our permission

We may remove User Content and suspend or terminate accounts that we reasonably believe violate these Terms or our policies.

- The Service (including design, text, graphics, logos, and software, but excluding your User Content) is owned or licensed by us and is protected by intellectual property laws.
- "Beacon" and our logos and product names are our trademarks. You may not use them without our prior written permission.
6.2 Feedback
- If you provide feedback or suggestions about the Service, we may use them without any obligation to you.
7. Privacy and Data
- Our collection and use of personal information is described in our Privacy Policy and, where applicable, our Child Safety Standard.
- By using the Service, you consent to such collection and use in accordance with those documents.
8. Disclaimers
8.1 No Professional Advice
- The Service is for informational and social use only. It is not a substitute for professional medical, fitness, or safety advice.
- Activity and health data (e.g., distance, duration, routes) are estimates. Do not rely on the Service for medical or safety-critical decisions.
8.2 "As Is"
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
9.1 To the fullest extent permitted by law:
- WE (AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
9.2 Our total liability for any claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us, if any, in the twelve (12) months before the claim, or (b) one hundred US dollars (USD 100).
9.3 Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, the above limitations may not fully apply to you.

11. Termination

- Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) will survive.

- We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date, or by other reasonable means.

13.1 Governing Law and Venue
- These Terms are governed by the laws of Indonesia, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Jakarta, Indonesia, except where prohibited by mandatory law in your jurisdiction.
13.2 Entire Agreement
- These Terms, together with our Privacy Policy and any other policies we reference, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
13.3 Severability
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
13.4 No Waiver
- Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
